By engaging NoMoreRubbishWebsites for any web design or development service, you agree to be bound by these Terms and Conditions. If you do not agree, please do not proceed with an order. These terms form a legally binding contract between you and NoMoreRubbishWebsites.
Definitions
In these Terms and Conditions, the following words have the following meanings:
- "We", "us", "our" refers to NoMoreRubbishWebsites, a sole trader business operating in Scotland, United Kingdom.
- "You", "your", "the Client" refers to the individual or business that has engaged our services.
- "Project" means the website design and/or development work agreed between us as set out in the project brief or quotation.
- "Quote" means the written price and scope of work we provide before starting any project.
- "Brief" means the information you provide us describing your requirements, preferences, content, and goals.
- "Deliverables" means the completed website files, pages, and associated assets produced as part of the Project.
- "Hosting" means the third-party server service that makes your website accessible on the internet.
- "Domain" means your website address (e.g. yourbusiness.co.uk).
- "Logins" means all usernames, passwords, and access credentials for your website, hosting account, and domain registrar.
- "Final Payment" means the last payment due before handover of logins and live deployment, as set out in Section 7.
The Agreement
A binding contract between you and us is formed when both of the following have occurred:
- You have received and accepted our written Quote (by email, message, or signing this document); and
- You have made the deposit payment as set out in Section 7.
No work will begin until the deposit has been received. Accepting a quote verbally or by email constitutes acceptance of these Terms and Conditions in full.
Important: These Terms and Conditions apply to all projects we undertake, regardless of whether a separate written contract has been signed. By paying the deposit, you confirm you have read and agreed to these terms.
Our Services
We provide web design and development services for small and medium-sized local businesses. Our services include but are not limited to:
- Website design and build (Landing package — single-page site)
- Website design and build (Starter package — up to 3 pages)
- Website design and build (Professional package — up to 7 pages)
- Website refresh and redesign of existing sites
- Contact form setup and integration
- Basic SEO setup including meta titles, descriptions, and Google indexing
- Google Maps and social media integration
- Mobile-responsive design
- Domain and hosting setup assistance
- Post-launch support within the aftercare period
What is not included
Unless explicitly stated in your Quote, the following are not included in our standard packages:
- Domain name registration or renewal fees
- Hosting fees (ongoing monthly or annual costs)
- Copywriting or content creation
- Photography or videography
- Logo design or brand identity work
- E-commerce / online shop functionality
- Ongoing maintenance beyond the aftercare period
- Paid advertising (Google Ads, Meta Ads, etc.)
- Advanced SEO campaigns or ongoing SEO management
If you require any of the above, please ask us and we will provide a separate quotation.
The Build Process
Every project follows a structured process to ensure the final website reflects your business accurately. We do not begin design or development work without first consulting with you.

Timelines
Quoted build times run from the date we receive all required content from you, not from the date of deposit. We cannot be held responsible for delays caused by late content, slow feedback, or lack of communication from the Client.
We will make every reasonable effort to meet agreed timelines. If we anticipate a delay on our part, we will notify you as soon as possible.
Revisions
All packages include up to 3 rounds of revisions following the initial preview. A "round" means one set of consolidated feedback responded to with one updated version of the site.
What counts as a revision
- Changes to text, colours, fonts, or layout
- Adding or removing content elements
- Adjustments to images or image placement
- Changes to page structure or navigation
What does not count as a revision
- Fixing genuine errors or bugs caused by us
- Changes required due to our misunderstanding of the agreed brief
- Minor text corrections (spelling, factual errors)
We strongly recommend consolidating all feedback into a single response per round. Piecemeal or drip-fed feedback may use up revision rounds more quickly. Each time you send a set of changes and we implement them, that constitutes one revision round.
Additional revisions
If you require changes beyond the 3 included rounds, additional revisions are charged at £50 per hour, billed in 30-minute increments. We will always confirm the estimated time and cost before proceeding.
Scope changes
If you request changes that significantly alter the scope of the project from the original brief — such as adding new pages, new features, or major structural redesign — this may constitute a new quotation rather than a revision. We will advise you clearly if this is the case.
Your Responsibilities
A successful project is a collaboration. To allow us to deliver your website on time and to the agreed standard, you agree to:
- Provide a complete and accurate brief before work begins
- Supply all required content (text, images, logo, brand guidelines) in a timely manner — ideally within 5 working days of us requesting it
- Ensure all content you provide is owned by you or that you have the legal right to use it
- Make yourself reasonably available for questions, clarification, or feedback during the build
- Provide consolidated feedback within each revision round rather than sending changes piecemeal
- Respond to preview links and milestone requests within 5 working days
- Ensure any third-party accounts (hosting, domain) we need access to are made available to us promptly
- Make payments on time as agreed in Section 7
Content ownership
You confirm that any content, images, text, or materials you provide to us are either owned by you or that you hold a valid licence to use them. We accept no liability for any copyright infringement arising from content supplied by you.
If you use stock images, we recommend licensed sources such as Unsplash, Pexels (free), or Shutterstock (paid). We can advise on this if needed.
Fees & Payment
Pricing
All prices are as quoted in writing before the project begins. Our standard packages are:
- Landing Website — from £299 (2-day build, single page — designed for very small businesses)
- Starter Website — from £499 (3-day build, up to 3 pages)
- Professional Website — from £999 (7-day build, up to 7 pages)
- Custom projects — priced individually per written quote
Prices are quoted exclusive of VAT. If we become VAT registered, we will notify you in advance and update our pricing accordingly.
Payment structure
All projects are subject to the following payment terms:
Deposit (50%): Due before work begins. No work starts until the deposit is received.
Final Payment (50%): Due upon your written approval of the completed website preview, and before the website is launched and logins are handed over.
For projects under £300, full payment upfront may be requested at our discretion.

Late payment
If any payment is not received within 7 days of the due date, we reserve the right to:
- Pause work on the project until payment is received
- Charge interest on overdue amounts at 8% above the Bank of Scotland base rate, in line with the Late Payment of Commercial Debts (Interest) Act 1998
- Withhold delivery of final files, login credentials, or launch of the website
Expenses
Any third-party costs incurred on your behalf — such as purchasing stock images, premium plugins, or fonts specifically requested by you — will be charged at cost and added to your invoice with prior agreement.
Handover of Logins & Access
Full payment must be received before any login credentials, access details, or live deployment takes place. This includes but is not limited to: CMS logins, hosting account credentials, domain registrar access, FTP/SFTP details, and any third-party platform accounts set up on your behalf.
Once final payment has cleared, we will hand over the following within 1 working day:
- Website CMS login (username and password)
- Hosting account login and server details (where applicable)
- Domain registrar account credentials (where we have registered the domain on your behalf)
- Any other platform logins set up as part of the project (e.g. Google Analytics, Google Search Console)
- A handover document explaining how to manage and update your website
Existing accounts
Where you already hold a hosting or domain account and have granted us access to work on your behalf, we will retain only the access required to complete the project. Upon project completion and final payment, we will confirm the removal of any temporary access we were granted.
Security
We strongly recommend that you change all passwords after handover. We accept no responsibility for any security issues that arise after login credentials have been transferred to you.
Ownership & Intellectual Property
Transfer of ownership
Upon receipt of full and final payment, all intellectual property rights in the completed website design and code transfer to you, the Client. You will own the site outright — including all files, designs, and assets created specifically for your project.
Until final payment is received, all work remains the intellectual property of NoMoreRubbishWebsites.
Our portfolio rights
We reserve the right to display your completed website as part of our portfolio and in our marketing materials (website, social media, case studies) unless you specifically request otherwise in writing before the project begins. We will never share sensitive business information — only the visual design of the site.
Third-party components
Some projects may incorporate open-source frameworks, fonts, or plugins. These remain subject to their own licences. We will advise you of any such components used in your project.
Content you provide
All content supplied by you (text, images, logos) remains your property at all times. We will not use your content for any purpose other than building your website.
Aftercare Support
Following launch, all packages include a period of complimentary aftercare support:
- Landing package: 14 days from launch date
- Starter package: 30 days from launch date
- Professional package: 60 days from launch date
What aftercare covers
- Fixing any bugs or errors that appear in the completed website
- Minor content corrections (text updates, image swaps)
- Guidance on how to use and update your website
- Technical questions relating to the website we built
What aftercare does not cover
- New pages, sections, or features not included in the original brief
- Issues caused by third-party hosting or domain providers
- Issues caused by changes you or a third party make to the website after handover
- Ongoing SEO management or marketing
After the aftercare period ends, support and maintenance can be arranged at our standard rate of £50 per hour or via a monthly maintenance package (available on request).
Cancellation
Cancellation by you
You may cancel the project at any time by notifying us in writing. The following applies depending on the stage of the project:
- Before work begins: Deposit is forfeited to cover our scheduling and preparation time. No further charge applies.
- After work has begun but before preview: The deposit is forfeited in full. An additional charge may apply for work completed, calculated at £50 per hour, up to the total project fee.
- After preview has been delivered: Full project fee is payable. The deposit is non-refundable and the remaining balance becomes immediately due.
Cancellation must be made in writing via email to info@nomorerubbishwebsites.com.
Cancellation by us
We reserve the right to cancel a project in exceptional circumstances, including (but not limited to):
- Non-payment or persistent late payment
- Abusive, threatening, or unreasonable behaviour toward us
- A project brief that requires us to produce content that is illegal, defamatory, or in breach of any applicable law
In the event of cancellation by us, we will refund any payments received minus the value of work already completed, calculated at £50 per hour.
Project abandonment
If a project is stalled for more than 30 days due to inaction on your part (e.g. failure to provide content, failure to respond to communications), we reserve the right to treat the project as abandoned. In this case, the deposit is forfeited and the project will be closed. Restarting the project may require a new quote and new deposit.
Limitation of Liability
Our liability
We will always endeavour to deliver high-quality work. However, our total liability to you for any claim arising from a project — whether in contract, tort, or otherwise — is limited to the total fees paid by you for that specific project.
We are not liable for:
- Loss of business, revenue, profits, or opportunity arising from any issue with the website
- Data loss caused by hosting providers, server failures, or third-party platforms
- Errors arising from inaccurate, incomplete, or misleading content provided by you
- Any downtime, errors, or security breaches that occur after login credentials have been handed over to you
- Actions taken by you or third parties that alter or damage the website after handover
- Failure of the website to rank in search engines — we set up SEO correctly but cannot guarantee rankings
Third-party services
We may recommend or set up third-party services such as hosting providers, domain registrars, or analytics platforms. We are not responsible for the performance, availability, pricing changes, or terms of these third-party services.
Confidentiality
Both parties agree to keep confidential any sensitive business information shared during the course of the project. This includes business strategies, financial information, customer data, and any information clearly marked or communicated as confidential.
We will not disclose your confidential information to any third party without your prior written consent, except where required by law.
This obligation of confidentiality does not apply to information that is or becomes publicly available through no fault of ours, or that we were already aware of before you shared it with us.
Data protection
We handle any personal data you share with us in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Please refer to our Privacy Policy for full details of how we collect, use, and store your data.
Governing Law & Disputes
These Terms and Conditions are governed by and construed in accordance with the law of Scotland. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the Scottish courts.
Resolving disputes
Before raising any formal dispute, we ask that both parties make a genuine effort to resolve any disagreement informally. Please contact us in the first instance at info@nomorerubbishwebsites.com and we will respond within 3 working days.
If informal resolution is not possible, we are willing to consider mediation as an alternative to legal proceedings before either party commences formal legal action.
Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Entire agreement
These Terms and Conditions, together with the written Quote accepted by you, constitute the entire agreement between the parties and supersede all prior discussions, representations, or agreements whether written or oral.

For larger projects, both parties may wish to sign below to confirm agreement to these terms alongside the project quote. This is optional — acceptance of the quote and payment of the deposit also constitutes agreement.
